The aviation security regulation relating to the EU ACC3 programme was, until recently, Commission Regulation (EU) No. 185/2010. Regulation 185/2010 laid down detailed measures [as referred to in Article 4(3) of Regulation (EC) No 300/2008] for the implementation of the common basic standards on aviation security.
185/2010 was amended 20 times since its entry into force. Therefore, in order to ensure clarity and legal certainty, it has been repealed and replaced by a new act that consolidates the initial act and all subsequent amendments.
The opportunity was also taken to clarify and update the text where appropriate, in the light of the practical experiences gained and relevant technological developments.
The new act is Commission Implementing Regulation (EU) No. 2015/1998, and is effective from 1st February 2016.

Non-public legislation
Some of the relevant EU requirements are contained in non-public legislation. Air carriers should be informed about these by the appropriate authority of the EU Member State responsible for their ACC3 designation, and they are distributed on a need-to-know basis. It is the responsibility of air carriers to ensure that these measures are implemented and, where necessary, the information is forwarded to third country business partners (RA3s and KC3s).
